General Terms and Conditions of Use

There are a couple of important Terms that apply to your use of the VMG website and VMG app. We’ve put them on the same page so you only have to look in one place.

The User Terms always apply when you’re using the VMG website and the VMG app. You’ll also need to agree to them when you create a user account and when you create fundraising page.

In addition, you’ll need to agree to the Donation Terms before you make a donation, set up a regular donation or pay an event fee.

User Terms

Please read these User Terms carefully. They may change every so often so it's a good idea to come back and read them again regularly to stay up-to-date. If we change the User Terms, we'll post them on this website and your future usage of the website will be subject to the updated User Terms. These User Terms were last updated on 25 May 2018.

1. These User Terms are between you and Virgin Money Giving Limited. You accept the User Terms by using our website. If you do not agree to the User Terms, you must not use our website.

3. When we say "VMG", "we", "us" or "our" in these User Terms, we mean Virgin Money Giving Limited (trading as Virgin Money Giving). When we say "Charity" or "Charities", we mean an organisation(s) or a charity(ies) registered in the UK that has signed up to VMG. Not all Charities are registered charities in the UK; you should contact them directly if you need more details about their authorisation status.

5. These User Terms apply to your use of the virginmoneygiving.com website (the "VMG Website") (including where you set up a fundraising page), the Virgin Money Giving mobile application (the "VMG app") and (if you have created one) your account. If you are making a payment through the VMG website, our Donation Terms will also apply. If you use the application programming interface service, the Developer User Terms will apply. Our Privacy Policy will apply at all times. As the Privacy Policy explains, we may share some of your personal information with Charities and other third parties. Please see the Privacy Policy for further details about the protection and processing of your personal information.

6. You don't have to create an account to use the VMG website. If you decide to create an account, you'll need to be aged 13 years or over.

7. You must not share your password or login details with anyone else. If your password or Facebook login details are compromised or used without your permission, you must change your password and/or login details as soon as possible.

8. We'll use the details on your account if we need to contact you.

9. If you want to close your account, please contact us.

10. We'll close your account if you've not used it for seven years.

11. In order to set up a fundraising page, you'll need to create an account.

12. The creation of a fundraising page on the VMG website doesn't mean that we or the Charity support or endorse your fundraising activity. If you're not sure, you can check with the Charity that your chosen activity is acceptable.

13. We can close your fundraising page at the request of the Charity or at our own discretion.

14. While we try to ensure that the VMG website and the VMG app are always available, we can't guarantee that the VMG website or any content on it will always be available. For example, there may be times when our website, or parts of the website, are temporarily unavailable due to planned maintenance.

15. We can suspend your access to the VMG website, the VMG app and/or your account at our discretion. In particular, we can do this if we suspect that your security or login details are being misused.

16. You agree that you won't post content or information on the VMG website or the VMG app that:

  • breaks any law or encourages an illegal act;
  • is defamatory, abusive or offensive;
  • infringes the copyright, privacy, confidentiality or other right of any third party. If you use someone else's personal information, material or image, you must make sure you have their permission;
  • contains surveys, raffles, lotteries, contests, pyramid schemes, advertisements or chain letters; or
  • contains software viruses or any other computer code, files or programs designed to affect the use of any computer software or hardware or telecommunications equipment.

17. You're not allowed to remove or change anything on the VMG website and the VMG app other than the content on your fundraising page. In addition, you can't:

  • pretend to be someone else, or that you are associated with someone or something when you are not; or
  • use the VMG website to send junk email or 'spam'.

18. The content on the VMG website and the VMG app is for general information only. It's not intended to be advice for you to rely on so you should consider getting professional or specialist advice before acting on it.

19. We don't verify or approve any content or information on the VMG website or the VMG app that is created by other users and/or Charities so we don't take responsibility for it (although we'll remove or disable unlawful or offensive content if we become aware of it). The views expressed by other users and Charities are their own views so they won't always reflect our views and values.

20. The VMG website and the VMG app will sometimes link to other websites. We don't have control over those websites and we're not responsible for them (including their data policies, content, and security).

21. You own all of the content and information you post on the VMG website and the VMG app. You agree to the following:

  • For content that is covered by intellectual property rights, like photos and videos that you post on or in connection with VMG ("IP content"), you give VMG permission to use the IP content anywhere in the world, forever and without charge and you give us permission to edit the IP content. You also agree that we can transfer or give permission to use and/or edit the IP content to another party; and
  • You can ask us to stop using the IP content by contacting us when you delete it on your account (except to the extent your content has been shared with others, and they have not deleted it). When you delete (or you ask us to delete) the IP content, it is deleted in a manner similar to emptying the recycle bin on a computer. You understand that removed content may persist in backup copies for a reasonable period of time (but will not be available to others).

22. Otherwise, we own or have permission to use all of the intellectual property rights on the VMG website and the VMG app and in the material published on them ("VMG content"). VMG content includes (but isn't limited to) information, designs, graphics and their layout.

23. You need written permission from us before you:

  • use any part of the VMG content for commercial purposes; 
  • copy, reproduce or download all or any part of the VMG content.

24. If you don't get written permission first, you must return or destroy any copies of the VMG content you have made if we ask you to.

25. We may change these User Terms because of changes:

  • in technology or the systems we use;
  • to meet our legal or regulatory obligations;
  • to make them clearer or more favourable to you or to correct errors; and
  • to introduce or remove services or to reflect changes to the way in which the VMG website is managed.

26. We won't give you notice but you'll always be able to find the most up-to-date version on the VMG website.

27. You use the VMG website and the VMG app at your own risk. We are not liable for any loss or damage which you may suffer through the use of VMG website and the VMG app. Nothing in these User Terms is meant to limit our responsibility more than the law allows us to.

28. If you break the User Terms or the Donation Terms, or you are abusive or threatening to our team, another user or a Charity we can stop you from using all or part of the VMG website and the VMG app (including closing your account) and delete any content that you have posted. We can also close your account and cancel any future regular donations.

29. No one other than you and us will be able to enforce any part of the User Terms.

30. If you live in Scotland, Scots law applies and the Scottish courts will handle any disputes. If you live in Northern Ireland, Northern Ireland law applies and the Northern Irish courts will handle any disputes. If you live anywhere else, English law applies and the courts of England and Wales will handle any disputes.

31. If we don't deliver the standard of service you expect or if you think that we have made a mistake, email us at theteam@virginmoneygiving.com. We'll investigate and, if necessary, take action to put things right.

Donor Terms

Please read these Donation Terms carefully. These Donation Terms were last updated on 25 May 2018.

1. These Donation Terms are between you and Virgin Money Giving Limited. You must be aged 13 years or over to agree to these Donation Terms.

As the Privacy Policy explains, we may share some of your personal information with Charities and other third parties. Please see the Privacy Policy for further details about the sharing and protection of your personal information.

5. These Donation Terms apply to donations or event fees. You'll need to agree to them every time you make a single donation, set up a new regular donation or pay an event fee through the virginmoneygiving.com website (the "VMG website").

6. We won't tell you if these Donation Terms change but you can always find the latest version of these Donation Terms on the VMG website.

7. You can use the VMG website to make three types of payments to Charities:

  • Single donation – a one-off donation that we'll ask your card provider or PayPal to send to us straightaway.
  • Regular donation – a regular donation to a Charity made through a "continuous payment authority" using your card or PayPal details. This means that we'll ask your card provider or PayPal to send the donation amount to us each month on the day you agreed when setting up your regular donation.
  • Event fee – payment of fees to enter into an event, like a marathon. When you pay the event fee, you'll enter into a contract directly with the Charity. We're not responsible for the event and you should contact the Charity with any questions about the arrangements.

8. In order to make a donation or pay an event fee, you'll need to select the correct Charity or fundraising page and:

  • provide your name and address and the details of the credit or debit card or PayPal account that you wish to use to make the donation or pay the event fee;
  • double check that the details of the donation or event fee are correct (including the name of the Charity); and
  • occasionally, you may be asked to provide additional information too.

9. If you want to make a single donation or set up a regular donation, you'll need to confirm whether you want us to submit a claim for Gift Aid on behalf of the Charity. You're responsible for confirming that your donation meets the criteria necessary to submit a Gift Aid claim. We can't give financial or tax advice so, if you're not sure whether to agree, you should seek advice from HMRC or your own adviser(s).

10. As soon as you confirm a single donation or pay an event fee through the VMG website, we'll request the money from your card provider or PayPal. Once we receive confirmation that your payment has been authorised, we'll confirm on the next page and email you. You must double check these details to make sure they are right.

11. As soon as you confirm a regular donation on the VMG website, we'll provide confirmation to you on the next page and email it to you. You must double check these details to make sure they are right. We'll ask your card provider or PayPal to send the first donation to us on the date that you set up the regular donation and then any subsequent payments on the day of the month that you choose starting in your chosen month when setting up your regular donation.

12. We only accept payments in pounds sterling. If you make a donation or pay an event fee in a different currency, your card provider or PayPal will convert the amount into pounds sterling in accordance with your agreement with them.

13. When we receive the money from your card provider or PayPal, we'll hold the money on trust for the Charity until we pay it to them every week in accordance with our agreement with them. If you have signed up to receive marketing from the Charity, we'll also share details about you with them. We'll also share your details with the Charity if you've paid an event fee.

14. We won't process a donation or event fee if we reasonably suspect that:

  • you aren't permitted to use the VMG website under these Donation Terms or the User Terms;
  • the donation or event fee is illegal or is related to fraudulent activities;
  • the donation or event fee hasn't been properly authorised; and/or
  • the information about the donation or event fee isn't correct or is incomplete.

15. If we can't pay your donation or event fee to the Charity or if we reasonably feel that it's not appropriate to (for example, they've been deregistered by the Charity Commission), we'll try to refund you using the same payment method you used. If we can't do that, we'll contact you to arrange the return of the money. If we can't get hold of you, we'll give the money to an alternative Charity that we choose. We may also cancel any future regular donations if we believe that we won't be able to send your regular donation to the Charity in the future.

16. If we don't request the correct amount of money from your card provider or PayPal in line with your instructions, we'll refund the money to you (or, for an overpayment, refund the excess). You're responsible for checking that you've selected the right Charity when you make a payment but if we send the money to a different Charity by mistake, we'll refund you.

17. You can't revoke authorisation for donation or payment of an event fee. However, if you make a mistake making a donation or payment, please contact us straightaway:

  • If the money hasn't already been taken from your account with your card provider or PayPal, we'll try to cancel the payment completely.
  • If we've received the money, we'll try to return it to you but we won't be able do that if we've already paid the money to the Charity. If that happens, you should contact the Charity.

18. If your card or PayPal details are used fraudulently or without your permission, please contact us straightaway.

  • If the money hasn't already been taken from your account with your card provider or PayPal, we'll try to cancel the payment completely.
  • If we've received the money, we'll try to return it to you but we won't be able do that if we've already paid the money to the Charity. If that happens, you should contact your card provider or PayPal.

19. You can cancel your regular donations through your account. The latest you can cancel is the end of the day before the donation is due to leave your account.

20. We may not be able to take your regular donation if your credit or debit card changes (for example, your card expires or you are issued with a replacement card). To ensure your donation goes ahead, you must update your card details in your account.

21. You can email us at theteam@virginmoneygiving.com.

22. If you have an account, we'll use the details held on that account to get in touch with you. Otherwise, we'll use the details you provide to us before making your donation. We'll only ever communicate with you in English.

23. We can't guarantee how a Charity will use donations or event fees. How they use the donations or event fees is at their discretion and it's their responsibility to ensure that any donations or event fees are used in accordance with any stated purpose or specific fundraising appeal. You should contact the Charity if you want to find out more.

24. If you break the User Terms or the Donation Terms or you are abusive or threatening to our team, another user or a Charity, we can stop you from using all or part of the VMG website and the VMG app (including closing your account) and delete any content that you have posted. We can also close your account and cancel any future regular donations.

25. No one other than you and us will be able to enforce any part of the Donation Terms.
